The Guardian Real Estate Team

These Terms of Service (“Terms”) govern your use of services provided by The Guardian Real Estate Team, including its affiliated licensed real estate agents (“Agent,” “we,” “us,” or “our”). By engaging our services, visiting our website, or participating in a real estate transaction with us, you agree to these Terms.

1. Role of the Real Estate Agent

The Guardian Real Estate Team, licensed under Realty Professionals of Topeka as broker, provides licensed real estate brokerage services in accordance with Kansas law. Our role is to represent buyers and/or sellers in real estate transactions by facilitating negotiations, preparing contracts using approved forms, coordinating with third-party professionals, and guiding clients through the transaction process.

We do not:

  • Perform legal services

  • Perform inspections or construction evaluations

  • Provide tax, accounting, insurance, or financial advice

  • Guarantee the condition, value, or future performance of any property

Clients are encouraged to consult qualified professionals for legal, financial, tax, inspection, engineering, insurance, and repair matters.

2. No Guarantee of Outcomes

While we use reasonable skill, experience, and diligence, real estate transactions involve inherent risks. We do not guarantee:

  • That a property will sell or close

  • Sale price, timing, or market performance

  • Loan approval or financing terms

  • Appraisal outcomes

  • Inspection results or repair negotiations

Any market analysis, pricing guidance, or estimated timelines are opinions only, not guarantees.

3. Third-Party Services & Realty Guardian Protections

Certain transactions may include access to Realty Guardian protection services (“RG Protections”), which are offered by an independent third-party provider and not by the real estate agent or brokerage.

Important Clarifications:

  • RG Protections are not insurance

  • RG Protections are not warranties

  • RG Protections do not replace inspections, legal review, or due diligence

  • Coverage terms, limits, eligibility, and exclusions are governed solely by the Realty Guardian Protection Agreement, not these Terms

The Guardian Real Estate Team does not administer, adjudicate, approve, deny, or pay claims related to RG Protections.

4. Limitation of Agent Liability

To the fullest extent permitted by law:

  • The Agent is not liable for acts, omissions, negligence, errors, or defaults of third parties, including but not limited to:

    • Inspectors

    • Contractors

    • Appraisers

    • Lenders

    • Title companies

    • Surveyors

    • Attorneys

    • Realty Guardian or any protection provider

  • The Agent is not responsible for hidden defects, future property conditions, environmental hazards, zoning changes, or governmental actions.

  • Any reliance on third-party reports or disclosures is at the client’s discretion.

5. Client Responsibilities

Clients agree to:

  • Review all documents carefully before signing

  • Perform independent due diligence

  • Obtain inspections and professional advice

  • Verify square footage, boundaries, zoning, and intended use

  • Communicate promptly and honestly

Failure to follow professional recommendations does not create liability for the Agent.

6. No Legal or Financial Advice

Information provided by The Guardian Real Estate Team—verbally, in writing, or online—is for general informational purposes only.

We do not provide:

  • Legal advice

  • Tax advice

  • Financial planning advice

  • Investment guarantees

Clients should consult licensed professionals for such matters.

7. Website & Online Content Disclaimer

Content on our website, social media, emails, or marketing materials:

  • Is informational only

  • May be updated without notice

  • Does not constitute a contractual offer

Market data, statistics, and examples are based on sources believed reliable but are not guaranteed.

8. Indemnification

You agree to indemnify and hold harmless The Guardian Real Estate Team, its agents, brokers, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms

  • Your failure to obtain professional advice

  • Your reliance on third-party services

  • Misrepresentations provided by you

9. Governing Law & Venue

These Terms are governed by the laws of the State of Kansas.
Any dispute shall be resolved in a court of competent jurisdiction located in Kansas.

10. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date.
