These Terms govern your use of The Guardian Real Estate Team website, communications, and real estate services.

These Terms of Service (“Terms”) apply to your use of The Guardian Real Estate Team website, forms, communications, and real estate services (“Services”). By accessing our website, submitting information, or engaging our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Scope & Relationship

The Guardian Real Estate Team provides licensed real estate services in coordination with our brokerage, Realty Professionals, Broker. These Terms do not replace any written agency agreement, brokerage disclosure, or contract you may sign in a specific transaction. If a signed agreement conflicts with these Terms, the signed agreement governs for that subject matter.

2. Real Estate Brokerage Services

We assist buyers and sellers with real estate transactions, which may include: property search or marketing, pricing guidance, negotiation support, coordination of showings, document preparation using approved forms, and transaction management.

You acknowledge we do not control the actions of other parties or third-party providers (including lenders, inspectors, appraisers, title companies, contractors, attorneys, and government entities).

3. No Legal, Tax, Insurance, or Financial Advice

We are not attorneys, tax advisors, insurers, or financial planners. Any information we provide is for general informational purposes only and should not be relied upon as legal, tax, insurance, or financial advice.

You are encouraged to consult qualified professionals regarding contracts, legal rights, tax consequences, insurance coverage, property condition, repairs, engineering, surveys, and financing.

4. No Guarantees

Real estate involves risk. While we use reasonable care and diligence, we do not guarantee:

  • That a property will sell or close
  • Any particular sale price, timeline, or market result
  • Loan approval, underwriting outcomes, or financing terms
  • Appraisal outcomes or property valuation
  • Inspection results or repair negotiations
  • Future property condition, performance, or appreciation

Any pricing guidance, comparable sales analysis, or estimated timelines are opinions based on available information and market conditions.

5. Client Responsibilities

You agree to:

  • Provide accurate and complete information
  • Review all documents carefully before signing
  • Meet deadlines and respond promptly when action is required
  • Perform appropriate due diligence, including inspections and professional consultations
  • Independently verify material property facts important to you (square footage, zoning, boundaries, permits, HOA rules, etc.)

Important

If you choose not to obtain inspections, legal review, surveys, or other professional advice when recommended, you assume the risk of that decision.

6. Third-Party Providers

Real estate transactions commonly involve third parties such as lenders, title companies, inspectors, appraisers, contractors, surveyors, attorneys, insurers, and government offices. These third parties are independent and not under our control.

We may provide referrals for convenience, but you are responsible for selecting and hiring any provider. We do not warrant or guarantee third-party services, pricing, availability, timelines, or results.

7. Third-Party Protection Services

In some transactions, you may be offered access to independent third-party protection or benefit programs. Any such protections are provided by third parties and are not provided by The Guardian Real Estate Team or our brokerage.

Realty Guardian (RG) Disclosure (if applicable):

  • RG is an independent third-party provider and has separate terms and eligibility requirements
  • Any protections are subject to limits, exclusions, and separate agreements
  • These protections are not a substitute for inspections, legal review, due diligence, or insurance
  • The Guardian Real Estate Team does not administer, approve/deny, or pay RG-related claims

8. Limitation of Liability

To the fullest extent permitted by law, The Guardian Real Estate Team, its agents, and affiliated brokerage are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services or participation in a real estate transaction.

We are not liable for the acts, omissions, negligence, errors, or defaults of third parties, including but not limited to lenders, inspectors, contractors, appraisers, title companies, surveyors, attorneys, or any third-party protection provider.

If liability is found notwithstanding the above, our aggregate liability will be limited to the fullest extent permitted by Kansas law.

9. Indemnification

You agree to indemnify and hold harmless The Guardian Real Estate Team, its agents, and affiliated brokerage from claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your breach of these Terms
  • Your misrepresentations or failure to disclose material information
  • Your misuse of the Services
  • Your actions or decisions contrary to professional recommendations

10. Website Use & Intellectual Property

Website content (text, graphics, logos, photos, videos, layouts, and code) is owned by or licensed to The Guardian Real Estate Team and is protected by applicable laws. You may view and print content for personal, non-commercial use only.

You agree not to misuse the website, attempt unauthorized access, scrape data, interfere with functionality, or use the website for unlawful purposes.

11. Privacy

Your use of the Services is also subject to our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy related to data handling, the Privacy Policy will govern.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict of laws principles. Any dispute arising from these Terms or the Services shall be brought in a court of competent jurisdiction located in Kansas.

13. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of the Services after an update constitutes acceptance of the revised Terms.
